Introducing the requirement for existing employees to obtain a Disclosure or apply for PVG membership can be complicated since it usually involves amending an existing contract of employment. Changing any employment conditions should always be handled carefully, so we suggest it is best done in consultation with those employees concerned.

The following pages will guide employers through the Disclosure process, with reference to current employment legislation. It should be noted that we cannot generalise about the process of terminating employment if an existing employee refuses to agree to the proposed changes to their contract of employment. If this situation arises, employers should consult with their HR team to follow their internal processes.
